1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the BI Productions booking funnel and YouTube Thumbnail Design Service (collectively, "Services"). By submitting a booking form, making a payment, or engaging with our Services in any way, you agree to these Terms and our Privacy Policy.

If you are booking on behalf of a business or other legal entity, you represent that you have authority to bind that entity to these Terms.

2. Description of Services

BI Productions provides professional YouTube thumbnail design services. Our Services include:

• Custom thumbnail creation based on client briefs
• 36-hour delivery from confirmed brief receipt
• CTR (click-through rate) optimisation based on design best practices
• A defined number of revision rounds as specified at the time of booking

We do not guarantee specific CTR percentages or channel growth outcomes. Our CTR Guarantee refers to our commitment to applying CTR-optimised design principles, not to a specific performance metric.

3. Booking & Payment

Bookings are confirmed upon receipt of full payment (or a deposit, as specified). All prices are as stated on the booking funnel at the time of purchase.

• Payments are processed by our third-party payment processors. By providing payment information, you authorise the charge.
• All prices are exclusive of applicable taxes unless stated otherwise. Clients are responsible for any taxes applicable in their jurisdiction.
• Payment is required before work commences unless otherwise agreed in writing.

4. Delivery & Guarantee

We aim to deliver your completed thumbnail designs within 36 hours of receiving a confirmed, complete creative brief. The 36-hour window begins when:

• Payment has been confirmed
• A complete creative brief has been received (including all required assets, references, and information)

If delivery is delayed beyond 36 hours due to our error (not missing client information), we will offer an appropriate remedy at our discretion, which may include a discount on future orders. Force majeure events, system outages, or client delays may affect delivery timelines without penalty to BI Productions.

5. Revisions & Approvals

The number of included revisions is specified at the time of booking. Revisions must be requested within 7 days of delivery. Additional revision rounds may be available for a fee.

A revision is defined as a modification of the existing design. A request for a fundamentally different concept may constitute a new project at additional cost.

Approval of the final design constitutes acceptance of the work. No further revisions will be provided after approval.

6. Intellectual Property

Ownership upon payment

Upon receipt of full payment and your approval of the final design, BI Productions assigns to you all rights, title, and interest in the final delivered thumbnail design, including copyright, for use in connection with your YouTube channel.

Our retained rights

• We retain the right to display completed work in our portfolio, case studies, and promotional materials unless you request otherwise in writing before delivery.
• We retain ownership of all working files, source files, and templates unless explicitly agreed otherwise.

Client-provided assets

You warrant that any materials, images, logos, or content you provide to us are owned by you or that you have all necessary licences to use them. You indemnify BI Productions against any claims arising from use of client-provided materials.

7. Client Responsibilities

• Provide accurate, complete, and timely creative briefs
• Ensure all assets and information provided do not infringe third-party rights
• Respond to queries within a reasonable time to avoid delays
• Use the delivered designs solely for lawful purposes

8. Prohibited Uses

You may not use our Services or the delivered designs to:

• Create content that is unlawful, defamatory, harassing, or fraudulent
• Infringe the intellectual property rights of any third party
• Create misleading thumbnails that violate YouTube's Community Guidelines or Terms of Service
• Resell or redistribute our services without our express written consent

9. Disclaimers

Our Services are provided "as is." To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that use of our designs will result in any particular YouTube performance outcomes, including views, clicks, or subscriber growth.

10. Limitation of Liability

To the maximum extent permitted by law, BI Productions' total liability to you for any claim arising from these Terms or the Services shall not exceed the amount paid by you for the specific order giving rise to the claim.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of profits, or loss of data.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under applicable law.

11. Refund Policy

Refunds are considered on the following basis:

• Before work commences: Full refund upon written request
• After work commences: Partial refund at our discretion, reflecting work completed
• After delivery: No refunds are offered once the final design has been delivered and approved

If you are a consumer in the EU, EEA, or UK, you may have statutory rights to a 14-day cancellation period. This right lapses once digital content delivery has commenced with your explicit consent. By confirming your booking and requesting immediate commencement of work, you acknowledge this.

12. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of Jalandhar, Punjab, India jurisdiction. We aim to resolve all disputes amicably before initiating formal proceedings.

Consumers retain the right to bring proceedings in their local courts as afforded by applicable consumer protection legislation. EU consumers may also access the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or prominent notice on our booking funnel. Continued use of our Services after changes constitutes acceptance of the revised Terms.
